InterCity Make Someone's Day Competition Terms and Conditions


1. Introduction

  1. Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry.

2. Eligibility

  1. Entry is only open to persons aged 18 years or older (Entrants). The directors, management and employees (and their immediate families) of Entrada Travel Group (Promoter), its related entities, providers and agencies who are directly associated with the conduct of this promotion are ineligible to enter the promotion.


3. Promotional Period 

  1. The first promotional period starts at 5pm (NZDT) on the 2nd of December and closes at 11.55pm (NZDT) on the 15th December 2024.

  2. The second promotional period starts at 5pm (NZDT) on the 16th of December and closes at 11.55pm (NZDT) on the 29th December 2024.

  3. Entry will be available via the Promoter’s Website on the Competition Entry Page. All entries received during the Promotional Period(s) will be included in the draw.
     

4. How to Enter

  1. Enter the competition via the Promoters Online Entry Form (https://cv7olhafzp5.typeform.com/to/Tzr2VpbT) during the promotional period(s) and;

  2. Fully and correctly complete the entry form, including providing the Entrant’s full name, telephone number, current and valid email address, and consent to the use of the submission for future marketing purposes.

  3. Only one (1) entry per person is permitted for each eligible period of the competition. Any subsequent entry by the same person after the first valid entry is received from that person will be deemed invalid.

  4. Entries received will be considered final by the Promoter. Incomplete, manufactured, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly by an Entrant on their entry form will deem their entry invalid.

5. Draws

  1. The first prize draw will take place at Level 1, Building A, The Millennium Centre, 600 Great South Road, Greenlane, Auckland, at 12pm (NZDT) on the 16th December 2024.

  2. The second prize draw will take place in the same location, at 12pm (NZDT) on the 30th December 2024

  3. All entries received during the Promotional Period(s) will be entered into the corresponding Draw to determine one (1) winner.

  4. The winner will be notified by email or phone and their name will be announced in a social media post, by the 7th business day after the draw. All reasonable steps to notify winners of the results of the Draws will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.


6. Prizes

  1. For the Draws, the first eligible entry randomly drawn from all entries received during the Promotional Period(s) will win the prize of a $200 NZD InterCity Travel Voucher. The prize is redeemable for travel credit with InterCity services.

  2. The winner will be contacted by the Promoter to arrange the delivery of the prize voucher. The validity of the prize redemption is 12 months (365 days) from the date a winner is notified that they have won. Black out dates may apply to the use of the travel credit.

  3. The Promoter reserves the right to request a winner produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the identity of the winner before issuing the prize.

 

7. General 

  1. The total prize value is $200 NZD. The prize is not transferable or exchangeable and cannot be taken as cash. The prize can only be redeemed for standard InterCity services and cannot be redeemed for any third-party provider services, including Interislander ferry travel. The prize cannot be used or redeemed in conjunction with any other offer. The prize does not include any accommodation or any other expenses relating to travel, accommodation or food and drink. 
  2. The Promoter may conduct an unclaimed prize draw which will take place at Level 1, Building A, The Millennium Centre, 600 Great South Road, Greenlane, Auckland, as is necessary at the end of 48 hours after the draw(s) in order to distribute the prize(s) if unclaimed by that date. In the event of an unclaimed prize draw, the winner will be notified in writing (email) or by phone. All reasonable steps to notify the winner of the results of the unclaimed prize draw (if any) will be taken by the Promoter. The Promoter’s decision is final and no further correspondence will be entered into.
  3. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, eligibility to enter and claim a prize, and any information submitted by the Entrant in entering the promotion, before issuing a prize. If any documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s (or its nominated agent’s) satisfaction then all the entries of that Entrant may be ineligible and deemed invalid.
  4. The Promoter reserves the right to verify the validity of any and all entries and to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting written entries or imagery generated using artificial intelligence; (c) submitting an entry which is not in accordance with these Conditions of Entry; or (d) engaging in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  5. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter.
  6. To the maximum extent permitted by law, you agree that InterCity will not be liable to you for any loss or damage, however caused, arising out of your participation in the Promotion.
  7. If the promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide alternative prize(s) to the same value as the original prize(s), subject to any written directions made under applicable State legislation.
  8. Entrants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter at marketing@entradatravelgroup.com. All Personal Information will be stored by the Promoter in accordance with the Promoter’s Privacy Policy. A copy of the Promoter’s Privacy Policy in relation to the treatment of Personal Information collected may be obtained by contacting the Promoter.
  9. By entering the promotion and by opting-in in the manner required on the entry form, Entrants acknowledge that a further primary purpose for collection of the Entrant’s Personal Information by the Promoter is to enable the Promoter to use the information to contact the Entrant in the future with information about the Promoter, including special offers, market research or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share an Entrant’s Personal Information with its New Zealand and overseas related companies, servants, employees and agents who may contact the Entrant for their legitimate commercial purposes, including special offers, market research or to provide the Entrant with marketing materials in this way. By entering the promotion and opting-in, Entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.
  10. You acknowledge that the Promotion is not sponsored, endorsed, administered by, or associated with Facebook and that Facebook has no liability to you in relation to the Promotion. You agree to fully release Facebook from any and all liability in relation to your participation in this Promotion.

Interpretation: In these Terms and Conditions, unless the contrary intention appears:

  1. the singular includes the plural and vice versa;
  2. dates or times are Auckland, New Zealand dates or times;
  3. a reference to 'include' or 'including' means 'including but not limited to'.
  4. Governing Law: The Terms and Conditions and membership in InterCity Account are governed by and will be construed in accordance with the laws of New Zealand, irrespective of where the application for Membership has been completed by the Member or submitted to InterCity. The New Zealand Consumer Guarantees Act 1993 may apply however it will not apply where Membership has been obtained, or a Member has represented it has been obtained, for business purposes, in which case provisions of that Act are excluded from these Terms and Conditions.
  5. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
